Welcome to Soughe.com. These are the Terms and Conditions governing your access to and use of Soughe.com, its related websites, mobile applications, and any associated services or tools (hereinafter referred to as the “Site”). These Terms and Conditions, including any linked information, form the User Agreement (“Agreement” or “Terms and Conditions”).

By accepting these Terms and Conditions, or by using the Site — whether to place an order or by registering — you acknowledge that you agree to comply with the Terms and Conditions of Soughe.com (“we”, “us”, or “Soughe.com”) in connection with your use of the Site or any related services.

By registering on the Site or placing an order, you agree to be considered a member of Soughe.com and to be bound by this User Agreement. If you do not agree to these Terms, please do not access, register, or use the Site.

For the purpose of this Agreement, Soughe.com refers to Milad Al-Sager General Trading, Marketing & Commercial Agencies LLC, including all its branches and subsidiaries.

Before becoming a member or continuing your membership, you must read and agree to this User Agreement and all related referenced information, which include other terms and conditions applicable to you as a user/member of Soughe.com. These include, without limitation, the Privacy Policy, which is incorporated herein by reference.

Soughe.com seeks to ensure that its members can enter legally binding contracts and that minors do not purchase inappropriate content.

Therefore, membership is not available to persons under 18 years of age. You must confirm that you are 18 years or older before becoming a member. Without prejudice to any other rights or remedies of Soughe.com under this Agreement or applicable law, Soughe.com reserves the right to restrict or withdraw access or membership if it determines that a user is under 18 or otherwise incapable of entering into a legally binding contract.

The Site is not available to users whose membership has been suspended or withdrawn by Soughe.com.

If you register as a business entity, you represent that you have the authority to bind that entity to this Agreement and that the entity will comply with all applicable e-commerce regulations.

When you register or place an order through the Site, you will be required to provide certain information and create a username and password for account access. You acknowledge that all information provided is true, accurate, and complete.

As a member, you agree to:
a. Be responsible for maintaining the confidentiality of your account and password and for restricting access to them. You accept full responsibility for all activities that occur under your account or password. You must notify Soughe.com immediately of any unauthorized use of your password or account or any other security breach. Soughe.com shall not be liable for any loss or damage arising from disclosure of your username or password. You may not use another person’s account without their express permission. You agree to indemnify Soughe.com for any unauthorized or unlawful use of your account.

b. Provide true, accurate, current, and complete registration data as requested by Soughe.com.

c. Maintain and promptly update your registration data to ensure accuracy and completeness. If any information provided is false, inaccurate, outdated, or incomplete, or if Soughe.com reasonably suspects so, Soughe.com reserves the right to suspend, restrict, or terminate your account indefinitely.

d. Soughe.com reserves the right (at its discretion) to conduct any verification it deems necessary (directly or via a third party) and to request additional information or documents such as ID, trade license, or proof of authorization. Failure to provide such information may result in suspension or termination of your account. Soughe.com also reserves the right to suspend inactive or unverified accounts.

You agree that Soughe.com may communicate with you via email, SMS, in-app notifications, or other messaging channels. You agree that all agreements, notices, and communications provided electronically satisfy legal requirements as if in writing. By accepting this Agreement, you authorize Soughe.com to send promotional emails or notifications about updates, offers, or account information. You may unsubscribe at any time by clicking the opt-out link in promotional emails or disabling notifications.

You acknowledge and agree that Soughe.com will make reasonable efforts to notify you of any material changes to this Agreement that increase your obligations or limit your rights. Soughe.com may, at its discretion and without liability, make non-material changes effective immediately by posting notice on the Site or via communication methods outlined in Section 5.

Membership is free, and there are no charges for browsing the Site. Soughe.com may modify service fees for promotional or new services (e.g., free shipping days), effective according to their stated terms. Unless otherwise stated, all fees and costs are payable in your local currency or as displayed on the Site. You agree to pay all applicable fees and charges for your order, including return or exchange costs and taxes.

By using Soughe.com, you grant us the right to use any information or data you provide (personal or otherwise) during registration, purchase, feedback, or any communication (“Information”), for managing and promoting the Site in accordance with the Privacy Policy.

By agreeing to this Agreement, you confirm the accuracy of all information provided to Soughe.com and agree not to:
• Use the Site in any way that may impair, damage, or disable it.
• Engage in any criminal, fraudulent, or unlawful activity that may harm others.

All content on the Site — including text, graphics, logos, images, icons, videos, and software — is the property of Soughe.com, its content suppliers, or licensors, and is protected by applicable intellectual property, trademark, and copyright laws. All rights to the Site’s content remain the exclusive property of Soughe.com.

The Soughe.com name, logo, and related marks are trademarks (registered or unregistered) owned by Soughe.com and protected by international laws. They may not be used in connection with any product or service not owned by Soughe.com or in a manner that may cause harm or confusion. All other trademarks appearing on the Site belong to their respective owners.

You must report any violations or potential violations of this Agreement via the contact information on the Site. If you believe your intellectual property has been infringed, notify Soughe.com immediately. Soughe.com reserves the right to suspend or block access to any user engaged in misconduct or infringement.

If returning or exchanging a product purchased via Soughe.com, you agree to:
a. Request a return within 2 days of delivery or within any period required by law.
b. Complete the “Return Form” included in your original order and attach it to the returned parcel.
c. Ensure the product is unused, sealed, and in its original packaging.
d. Contact us at +9647744400042 or through other contact details provided on the Site to arrange pickup.

Your return will be processed once received, and confirmation will be sent via email/SMS. Refunds or exchanges are subject to a successful quality inspection. Refunds will be issued as store credit or bank transfer depending on your choice. Processing times may vary based on your bank’s policies.

Soughe.com is not responsible for unsatisfactory performance, delays, or unavailability of products. Soughe.com makes no warranties regarding the quality, value, or merchantability of products. Soughe.com assumes no liability for third-party errors or omissions. Soughe.com is not liable for any financial, reputational, or indirect losses resulting from the use or inability to use the Site.

Soughe.com adopts reasonable physical, organizational, and technological measures to protect your personal data. However, as the internet is not a fully secure medium, Soughe.com cannot guarantee absolute privacy. Your information may be used to provide services and marketing materials in accordance with the Privacy Policy.

Soughe.com may, without liability, limit or terminate your access if:
• You breach this Agreement.
• Soughe.com cannot verify provided information.
• Your actions may cause legal liability.
• Fraudulent activity is suspected.

Soughe.com reserves the right to recover any losses or damages and take legal or criminal action if necessary.

Soughe.com may, at any time and without notice, suspend or terminate your membership for any reason, including violation of these Terms.

Soughe.com provides the Site and its services “as is” and “as available,” without any express or implied warranties, including merchantability, suitability, or accuracy. Soughe.com does not guarantee uninterrupted or error-free operation, virus-free servers, or data integrity. You use the Site at your own risk.

To the maximum extent permitted by law, Soughe.com, its officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential losses, including loss of profits, goodwill, business opportunities, data, or intangible losses arising from your use of the Site. If you are dissatisfied with the Site, your sole remedy is to discontinue use.

You agree to indemnify and hold harmless Soughe.com, its affiliates, officers, employees, and agents from any claims, losses, damages, or expenses (including legal fees) resulting from your violation of this Agreement or any applicable law.

Nothing in this Agreement shall be construed as creating a partnership or agency between you and Soughe.com. You have no authority to bind Soughe.com in any manner.

Any dispute, claim, or difference arising out of or relating to this Agreement shall first be resolved amicably through good-faith negotiations within 30 calendar days from written notice of the dispute by one party to the other.

You irrevocably grant Soughe.com the right to assign or transfer all or part of its rights or obligations under this Agreement to any affiliate or third party without prior notice. You may not assign your rights or obligations without prior written consent from Soughe.com.

If any clause of this Agreement is found invalid or unenforceable, the remaining clauses shall remain in full force. This Agreement constitutes the entire understanding between you and Soughe.com and supersedes all prior communications. Only the English text of this Agreement shall be legally binding in case of translation discrepancies.

For purchase orders executed by Soughe Iraq, this Agreement shall be governed and interpreted in accordance with the laws of the Republic of Iraq.

We may use your personal information to: Register you on Soughe.com and manage the services we provide. Fulfill our service obligations, including product purchases, delivery, and payment collection. Analyze and evaluate your shopping preferences to improve our products and marketing programs. Offer products or services that may interest you based on your data and browsing behavior. Send information, offers, and promotions by email, phone, text message, or other electronic communications.

You will have the option to refuse receiving such marketing communications. We may also combine your data with information received from third parties (e.g., credit reference agencies).
